ORDBR ' The Registrar of Trade Unions, Lahore Region has made an application under section 10(1) (i) (ii) of the Industrial Relations Ordinance, 1969 for cancellation of the registration of the Union because the Union had not submitted Forms 'D' and 'F'. Notice was given to the respondent and Zafar Iqbal, General Secretary of the Union appeared and stated that the required forms had been submitted.
At which, the representation of the Registar stated he would check and report. On the next date Mr. H. R. Haider, Advocate appeared on behalf of the Staff Union of Habib Bank and applied for being impleaded as a party. Reply of that application was filed.
2. I have heard the learned counsel for the parties. The applicant asserts that on the application of the applicants, complaint was filed against the respondent so applicant is a necessary party. He also relied on ruling of the learned Punjab Labour Appellate Tribunal given in petition No, LHR/274- 8I/Pb., decided on 29th September, 1981.
I have considered this contention. The Registrar of Trade Unions has moved for deregistration of the Union only on the ground that Forms D and 'F' regarding the subscription have not been filed. The complaint is not on any other allegation in which the applicant can render help because the cancellation has not been asked to be ordered on any other ground than this. So, in my view in the instant case, the applicant is not a necessary party.
3. Now, I deal with the merits of the complaint of the Registrar of Trade Unions. The defects pointed out by the Registrar have been removed. Statement of the representative of the Registrar has been recorded. Forms `D and `F' have been submitted so now the complaint is infructuous and is dismissed.
