ORDER

This is an application for bail on behalf of Nazir Ahmad and 6 others petitioners in a case under section 325/324/148/149, P. P. C. Registered at Police Station, Kunjah, District Gujrat vide F. I. R. No. 65/82, dated 26th May, 1982.

2. The prosecution case is that the petitioner in furtherance of their common object attacked Muhammad Yusaf, Sardar Khan, Mst. Shabnaz Begum, Mst. Surrayyia Bibi and Mst. Naziran Bibi in the area of Chak Saroo on 26th May, 1982 at 7 a. m.

3. Learned counsel for the petitioners submits that the alleged offences are not punishable with 10 years or more. The learned State counsel has, however, opposed this application.

4. After hearing the learned counsel for the parties I find that there are cross-cases and the alleged offences are not punishable with 10 years or more and as such grant of bail is a rule. The petitioners are, therefore, admitted to bail subject to their furnishing bail bonds in the sum of Rs. 10,000 each with one surety each in the like amount to the satisfaction of the Assistant Commissioner; Gujrat.
