ORDER

1. Allegedly a married woman Mst. Surayyah Begum while on her way to Mirpur in a bus was enticed away by the accused applicant and after having done so it is further alleged that adultery was also committed with her. She was then got boarded on a bus from Dudyal to Mirpur and Bus fare was also paid by him, but he did not accompany the woman in the bus. A She was handed over to the conductor to be let her led to Bhimber.

2. ' It is stated by the conductor and the driver of the bus that the woman after reaching Mirpur left for Pakistan by a bus and thereafter her whereabouts were not known.

' The Society has become so corrupt and immoral that to commit adultery has become a hobby and the women travelling lonely, fall an easy victim to vagabonds and Badmashs' and nobody takes care in the Society to stop such practices. In other words, no aid to the police is provided by the public at large with the result that the crime affecting morality cannot be brought under control. In this case, a large number of persons were involved in enticing away the woman with a criminal intent so as to have sexual intercourse with her but all of them were let off by the police treating them as innocent. The applicant being a person having no previous acquaintance with the woman is involved in the case. The woman had to even pass a night at the house of the driver. To what extent the driver is innocent. Nothing can be said. The accused applicant is in lock-up since over a month. Therefore, I feel to let him to be enlarged on bail.

4. ' That being so, this application for bail is accepted and the accused applicant is directed to furnish bail in the sum of Rs, 10,000 with one surety in the like amount to the satisfaction of Additional District Magistrate, Mirpur. A copy of this order shall be sent to the Additional District Magistrate, Mirpur for information etc. Of the accused applicant.
