1. The learned Civil Judge has found after spot inspection that prima facie the petitioner is liable to pay to the Government at least some substantial amount. In view of this the Civil suit was not competent without deposit of the amount he is called upon to pay to the respondent.
2. Notwithstanding this if a conditional stay order has been issued it would prove that the court has shown a concession to the petitioner. He cannot feel aggrieved against it.
