1. The appellant is officiating as yard master since 1978. His substantive post is of shunting porter. He on the basis of Demand No.. 41 of the industrial dispute claims to be confirmed as yard master.
2. According to demand No. 41 if a person has worked for one year on a post he is entitled to -be confirmed. The post of yard master is according to the learned lower Court a selection post.
3. Learned counsel for the appellant has not denied this fact. This is not the case of the appellant that he has undergone the test and has been selected by the selection committee. Unless he is selected for the post he cannot claim promotion and confirmation on any ground He has not derived any right by officiating on the post. The award dated 13-1-66 does not mean that a person who has not been regularly promoted to a selection post becomes entitled to be confirmed length of period of officiation is no ground.
4. Reliance has been placed upon a Circular Letter No. 831-E/480-VII (Policy) dated 13-12-74 but this letter too does not say that a person/A officiating on post derives right so be confirmed on it.
5. As a result of the discussion made above I do not find any force in the appeal and dismiss it in limine.' revisions by the competent authorities. Therefore, it is advisable to consult the official sources or legal professionals for the most up-to-date and accurate information.
