MASMOOD (CHAIRMAN).-By this appeal under section 8(I) of the Punjab Civil Services (Appellate Tribunals) Ordinance, 1970, Miss Amina Manthji, appellant, claims seniority over respondents Nos. 3 to 22 by setting aside the order of respondent No. 2 dated 29-10-70 and the Provisional Seniority List corrected up to 1-7-1969 (Annexure'A').
2. The appellant is represented by Mr. Muhammad Anwar 8hutta. There are 22 respondents.
3. Respondents Nos. 1 and 2 being Secretary to Government of Punjab, Education Department, and the Director of Education, Lahore Region are repre--sented by Mr. A. G. Hamayun, Government Pleader. Respondent No. 4 Mrs. Mansoora Qayyum Bhatti was represented by Mr. Khalid Javed, Advocate. Miss Razia Shaffi, respondent No. 5 is represented by Mr. Said Akhtar, Advocate. Miss Z.
4. Karam Bakhsh, respondent No. 6 is represented by Syed Ali Raza, advocate. Mrs. Malika Mushtaq Gillani, and Mrs. S. Karar, respondents Nos. 11 and 12 are present in person. The other respondents tare absent in spite of service.
5. The appellant is interested in getting her seniority determine in WPES-11 Administrative Branch, Women's Section. She from the appeal on 12-12-70, when her date of promotion to WPES-II Administrative Branch was 7-2-63. During the pendency of the appeal by Notification dated 26-1- 71, she was promoted to Class II w.e.f. 24-8-59. By this change in the date of promotion to Class II, she naturally gains in seniority. The learned counsel for the appellant, therefore, prays that a direction may be issued to respondents Nos. 1 and 2 to determine her seniority in accordance with her date of promotion to Class II without the Tribunal deciding the issues arising in the case or the seniority itself. The position is that neither party is in possession of Class II Rules which were originally in force. We may explain that the promotion of the appellant to Class II would be originally governed by the Class II Rules then applicable and the new Class II Rules which came into force in 1963, will operate pros--pectively and thus the seniority of the appellant vis-a-vis respon-- dents will have to be determined.
6. We, therefore, direct that the seniority of the appellant be re-determined in the light of the changed position within three---s months.
7. The appeal is disposed of accordingly. The parties are left to bear their own costs.
