This appeal emanates from the decision dated 6-1-1983 passed by the learned Presiding Officer, Punjab Labour Court No. 1, Lahore, whereby the grievance petition of the appellant for his re- instatement in service was dismissed on merits as well as being barred by time.

2. The appellant was retired on the ground-of attaining the age of superannuation of 60 years. The dispute is about - the date birth. In the service record the date of birth is given as 1-7-1923. The case of the appellant is that a clerk entered the date of birth in the service record so the same is not trustworthy. In 1972 the appellant was regularised as presently he was only a work-charged employee. He in 1972 declared his date of birth as 1-7-192.3 In spit; of it he was directed to get himself medically examined for age. But he paid a deaf ear to it. After his service book was completed and his date of retirement was mentioned, he brought medical certificate but his application was not accepted. Since once he had in 1972 declared his date of birth and his service book was completed mentioning in it his date of retirement, it became too late to ask for the change and that too merely on the basis of medical certificate A Such certificates are based upon rough opinion only. If copy of birth entry had been available, then there could be justification to change and correct the date of birth.

3. As a result of the observations made above, I do not find any force in the appeal and dismiss it in limine.
