ORDER

1. ' This revision was directed against the order dated 2-3-1982 passed by the learned Sub-Judge Kotli by which the evidence of the defendant-petitioners was closed. It was closed as the last opportunity afforded could not be availed of by them.

2. On 2-3-1982 when the case was called on for hearing the counsel for the petitioners appeared before the Court and submitted an application to the effect that the witnesses and the defendants who had to come from a very long distance were unable to attend the Court due to heavy rains.

3. The severity of the bad weather was apparent on its very face and it could be taken as an unavoidable circumstance beyond the control of the witnesses and the defendants who were to make their appearance before the Court on 2-3-1982. This aspect was totally ignored by the learned Sub-Judge and no order was made on the application moved by the counsel of the defendants for the requisite purpose.

4. ' That being so, the impugned order is liable to be set aside. The revision petition is accepted and the impugned order is set aside thereby affording an opportunity to the defendants to lead their evidence as well as to make their own statements as witnesses, if they desire to do so. The parties are directed to appear before the Court of Sub-Judge, Kotli on 28-4-1982 when the evidence as allowed by this Court shall be produced by the defendants. revisions by the competent authorities.
