' This revision petition under section 13 of the Consolidation of Holdings Ordinance, 1960, is directed against the order of the Additional Commissioner (Cons). Lahore dated 22-2-1982 whereby Kbasra No,. 1874 (8 Kanals class II), owned by the Central Government was excluded from its Khata and given to Muhammad Ishaq respondent In lieu of his Khasra No,. 349 (4 Kanals 3 Marlas Class I) on a suo motu proposal of the Collector (Cons.) Sialkot.
2. The petitioner have contended that the area of Central Government, which was included in its Khata during original consolidation scheme dated 31-12-1973 could not be competently withdrawn from it after a lapse of more than two years and given to the respondent Muhammad Ishaq on a suo moto proposal.
3. I have heard the parties through their counsels and have perused the record with case.
4. The record shows that Khasra No,. 1874 was owned by the Centre Government, was included in its Khata in the original consolidation schem dated 31-12-1979. The respondents contention that he was in possession of the Khasra number in question does not find any support from the record In these circumstances it was not competent to the Additional Commissioner (Cons.) to interfere with the original consolidation scheme and transfer the area of the Central Government to the respondent. Consequently I would alto this revision petition, set aside the order of the Additional Commissioner (Cons.) dated 22-2.1980 and direct that the Khata of the Central Government as confirmed in the original consolidation scheme dated 31-12-1979 be kept intact. .
