1. Adnan-ul-Karim Memon J:- The petitioners being aggrieved and dissatisfied with the impugned advertisement dated 14-03-2024, whereby the respondent No.2 has invited applications to fill teaching faculty posts in the University and its constituent college GMC Sukkur; therefore, petitioners pray to call for the record and proceedings of impugned advertisement and may further be pleased to check the legality, propriety, validity of its and cancel the same by directing the respondent No.2 to fill the vacancy positions on university basis through promotion on the premise that Shaheed Mohtarrama Benazir Bhutto Medical University created through legislation by Provincial Assembly of Sindh through Sindh Act No. VI of 2008 and it has two constituent general medical colleges viz. Chandika Medical College Larkana and Ghulam Muhammad Mahar Medical College Sukkur and hires teaching faculty by conducting competitive examination through its Selection Board and the faculty positions per provision of the act are filled either by way of initial appointment through University Selection Board or by way of promotion through Departmental Promotion Committee and services of its employees are regulated under the ACT, which provides a mechanism for appointment of teaching faculty and non-teaching faculty staff of the university; the syndicate is the executive body and an authority to exercise general supervision over the affairs and management of the university; the actions on the part of officers are always subject to the confirmation and ratification by syndicate; that in order to determine the criteria for appointment of teaching faculty placed in motion before syndicate. The Syndicate of the university in its 13th meeting held on 14th July 2012 through its resolution No. 13.12 held that 50% of the teaching faculty position shall be filled by promotion through departmental promotion Committee and issue such notification dated 01-09-2012 and the Syndicate of the in its 20th meeting held on 17-12-2013 resolve to assign the functions of Departmental Promotion Committee to the University Selection Board and decided to refer the promotion cases to University Selection Bard after getting report from committee and completion of necessary formalities; the University is bound under the law to implement the decisions of syndicate but they failed, which led to filing of the Constitution Petition No. 1646 of 2017 Re. "Dr. Muhammad Rafique & two others Vs. SMBBMU Larkana & others" seeking indulgence of this Court for implementation of decisions made by Syndicate of the University and by consent, the said petition was disposed of vide order dated 26-03-2019 with direction that 50% positions of the faculty members shall remain vacant to be filled through promotion and the present petitioners were also petitioners No. 2 & 3 in the said petition, the said order of this Court was challenged before the Apex Court in C.A No. 1620 of 2019 Re. SMBBMU Vs. Dr. Rafique Ahmed Memon & others which was also disposed of as withdrawn vide order dated 20-02- 2020 and then the petitioners time and again filed representations with University to hold meeting of departmental Promotion Committee for filling the 50 % vacancies of the academic staff by way of promotion, hence this petition.
