Through the instant intra Court appeal, the appellant, Ministry of Information Technology & Telecommunication, impugns the order dated 26.09.2016 passed by the learned Judge-in- Chambers only to the extent of the observations made in paragraph 8 of the said order. Through the said order, the writ petition filed by respondent No.1, who was the contract employee of Pakistan Telecommunication Company Limited, had assailed the letter whereby he was informed that his contract had expired. The petitioner in writ petition No.2720/2016 had also impleaded the Ministry of Information Technology and Telecommunication as well as the Telecom Foundation as respondents.

In paragraph 8 of the said order, learned Judge-in-Chambers has observed that Telecom Foundation, being the charitable and welfare organization established under the Charitable Endowments Act, 1890, is neither government organization nor performing functions in connection with the affairs of the Federation.

Although the employees of Telecom Foundation cannot file a writ petition with respect to a matter pertaining to the terms and conditions of their services, since the Telecom Foundation does not have any statutory service rules or regulations. The Telecom Foundation, as per Entry No.17, Serial No.8 of the Rules of Business, 1973, falls under the administrative control of the Information Technology and Telecom Division. Since the dominant control over the Telecom Foundation vests in the Federal Government, it is amenable to the Constitutional jurisdiction of this Court in matter other than service disputes.
4. The impugned order dated 26.09.2016 is modified to the above extent.
