ORDER

The instant writ petition is arising out of judgment dated 11.01.2022, passed by the respondent No.1- Assistant Commissioner (Saddar)/Authority under the Payment of Wages Act, 1936 (Act of 1936), whereby in application under the Act of 1936, respondent No.2 (Saqib Nawaz) was held entitled to recover an amount of Rs.3,90,000/- as gratuity.

2. The petition was initially taken up on 24.02.2022 when after hearing learned counsel for the petitioner, a notice was issued to the respondent No.2.

3. On the next date of hearing, i.e. 16.03.2022, respondent No.2 entered appearance and the matter was adjourned on the request of learned counsel for the petitioner for 01.04.2022.

4. Today, the respondent No.2, at the outset, stated that petitioner has redressed his grievances out of Court settlement. On this, learned counsel for the petitioner stressed upon setting aside of the impugned findings as the grievances of the petitioner had been redressed.

5. When confronted, the respondent No.2 acceded to above request and expressed no objection if the impugned judgment is set aside as his grievances have already been redressed.

6. Consequently, impugned judgment dated 11.01.2022 passed by the respondent No.1 on the basis of settlement arrived at between the parties is set aside and the instant writ petition is disposed of accordingly. revisions by the competent authorities.
