For the reasons to be recorded later, this criminal appeal is allowed, conviction and sentence awarded to the appellant, Noor Muhammad s/o Gul Ahmad, involved in case FIR No.282 dated 03.04.2019, registered under section 15-AA at Police Station Kalu Khan, District, Swabi, by the learned Additional Sessions Judge-III/Judge, MCTC, Swabi, vide judgment dated 30.09.2021, are set aside and he is acquitted of the charges levelled against him. He be set at liberty forthwith, if not required to be detained in any other case.
