' This appeal has been filed against the order dated 15-11-1976 of the Additional Commissioner (Rev.). Multan, by which he accepted the appeal of the respondent Co-operative Farming Society and set aside the order datekl 13-7-1976 of the Assistant Commissioner/Collector, Vehari.
2. Brief facts as alleged are that state land comprising Sq. No,. 42 Killa Nos, 1 to 15 situated in Chak No,. 178/EB was originally allotted to All Muhammad, father of the appellant in the year 1947, .Under Co-operative Farming Society. Ali Muhammad left the chak and the land was allotted to Nazir Muhammad appellant as nominee of his father. Subsequently some litigation started between Abdur Rehman who was in possession of the land on the one hand and the appellant on the other.
The former wanted to retain the land allotted in the name of his minor son Abdul Sattar, while the latter tried to get the same as nominee of Ali Muhammad. On 13-7-1976 the Assistant Commissioner/Collector allotted the land to the appellant and also directed delivery of possession to him. The respondent Co-operative Farming Society filed an appeal against this order which was accepted by the Additional Commissioner (Revenue) on 13-11-1976. The appellant has challenged this order in appeal.
3. I have heard the parties at length through their counsel and have also gone through the contents of the appeal and the relevant record. I have gone through various resolutions relevant to the case. There is nothing on the record to show that Nazir Muhammad Appellant was ever entitled as member of the Society and as such bad become entitled to allotment under the bye-laws of the Society. His claim to the land as nominee of his father is also not acceptable in that a nomination take effect only after the death of a member whereas in this case Muhammad Ali his father is reported to be still alive and has abandoned his tenancy long ago. The appellant, therefore, cannot claim the tenancy as a nominee of his father who has already lost his title. No, other substantial point has been urged. The appeal is without merit and is accordingly rejected.
