1. Vide my detailed judgment of even date passed in W.P. No.542/2020 (Shell Pakistan Ltd. through its Legal Counsel v. Single Bench, NIRC, Islama bad and 02 others) , the instant writ petition is hereby ALLOWED and all the orders passed by the learned Single Bench NIRC as well as by the Full Bench NIRC, whereby the status of Muhammad Shakoor (Respondent No.3) has finally been determined as a employee of the petitioner Company , are hereby SET ASIDE . The matter is remanded to the learned Single Bench NIRC, who shall proceed with the same from a stage where the petitioner Company as well as AAA FM file their detailed reply along with all record within next seven (07) days, whereafter the learned Single Bench NIRC shall frame issues, record evidence and decide the matter in accordance with law within the period of two (02) months, under intimation to this Court. It is made clear that no adjournment shall be granted by the learned Single Bench, NIRC to the petitioner Company as well as to AAA FM, who shall participate in the proceedings on each and every date.
