Through the instant writ petition, the petitioner , Sharafat Ali, who is an Assistant Superintendent (BPS-16) in the Works and Services Department, Government of Sindh. He has assailed notification dated 15.11.2021, whereby he has been directed to report to the Works and Services Department with immediate effect. When the said notification was issued, the petitioner 's services were at the disposal of the Comptroller , Sindh House, Islamabad.

Learned counsel for the petitioner submitted that the petitioner 's wife was posted on 21.06.2021 as Prosecutor General (Sindh) at the Hon'ble Supreme Court of Pakistan; that the petitioner was transferred and his services were placed at the disposal of Comptroller , Sindh House, Islamabad vide notification dated 10.09.2021 so that he could be at the same station as his wife; and that the petitioner 's transfer to Sindh would cause inconvenience to his family life and would also be against the wedlock policy set out in the Establishment Division' s office memorandum dated 13.05.1998. Learned counsel for the petitioner prayed for the notification dated 15.11.2021 for the transfer of his services to the W orks and Services Department, Government of Sindh to be set-aside.
3. I have heard the contentions of the learned counsel for the petitioner .
4. Admittedly the petitioner is a provincial civil servant and is serving as Assistant Superintendent (BPS-16) in the Works and Services Department, Government of Sindh. He was transferred vide notification dated 10.09.2021 issued by the Works and Services Department, Government of Sindh and his services were placed at the disposal of Comptroller , Sindh House, Islamabad.
5. True, the petitioner 's wife is serving in Islamabad, but the fact remains that the petitioner , in the instant petition, has agitated a matter regarding the terms and conditions of service. This Court, in exercise of Constitutional jurisdiction, cannot interfere with orders for the transfer and posting of civil servants.
6. In view of the above, the instant petition is dismissed in limine .
7. The petitioner has brought on record a representation dated 30.11.2021 to the Secretary , Works and Services Department, Government of Sindh seeking the recall of his transfer order . This Court cannot issue a direction to the Government of Sindh with respect to the petitioner 's transfer . However , there is nothing preventing the Secretary , Works and Services Department, Government of Sindh from deciding the petitioner 's said representation.
