The applicants have sought for release on bail by making an application u/s 497 Cr.P.C for the reason that they have been refused bail by learned trial Court.

The bail application of the applicants has been disposed of by learned trial Court without considering the arguments of learned counsel for the applicants with direction to be repeated after recording evidence of the complainant. Such disposal of the bail application of the applicants could hardly be said to have been recorded on merits.
3. Consequently , the bail application of the applicants would be deemed to be pending before learned trial Court to be disposed of afresh on merits in accordance with law , within fifteen days hereinafter .
4. The instant bail application is disposed of accordingly .
