1. Mr. Rana Sakhawat Ali, Advocate undertakes to file vakalatnama on behalf of respondent department.
2. This Petition was filed by impugning the recovery proceedings initiated by the respondent Department, during the pendency of the Appeal before the Commissioner Inland Revenue [Appeals-III] Corporate Tax Office (CTO), Karachi. The respective learned counsel jointly state that it may be just and proper to dispose of this petition with directions for expeditious conclusion of the appeal, while restraining the recovery of the impugned demand in the interim period.
3. Accordingly , this petition is disposed of by directing the Commissioner Inland Reve nue [Appeals-III] Corporate Tax Office (CTO), Karachi, to decide the pending Appeal preferably within 60 days from passing of this order . However , the respondents shall not take any coercive action against the petitioner , in respect of the impugned demand, till the conclusion of the Appeal.
