Muhammad Ali Mazhar , J. The petitioner has approached this court with the grievance that after rejection of their bid they filed representation/complaint to the redressal committee of responden t No.3 (SPPRA) but it was not decided.
2. Notice was issued to the respondents. Today the representative of SPPRA is present and submits that representation/complaint is pending but he raised a plea that the petitioner did not deposit the fee. Counsel for the petitioner submits that after filing represe ntation to SPPRA, fee was paid through pay order . He has submitted a copy of the pay order . In the meanwhile, learned Assistant Advocate General informed us that earlier tender was scrapped and after retendering, the same petitioner has also applied and submitted his financial and technical bid and the matter is pending before the competent authority of procuring agency to decide who is successful bidder therefore the representation/complaint has virtually become infructuous before SPPRA after retendering.

Learned counsel for the petitioner admits this contention however he raised the plea that in the retendering, petitioner did not deposit bid security amount and further argued that some directions may be issued that the earlier deposited bid security amount be considered for the bid submitted in response to retendering.

Mr. Ghulam Rasool Tunio, Focal Person, NICH, Karachi submits that the bid security amount of the earlier tender submitted by the petitioner has also already been accepted for the bid submitted in response to the invitation for retendering. The learned counsel for the petitioner is satisfied. The petition is disposed of accordingly alongwith pending application.
