Through instant writ petition, petitioner prays for dismissal of application under Section 12(2) of the Code of Civil Procedure, 1908 (C.P.C) filed by respondents 1 to 6.
2. On being confronted, learned counsel refers order dated 27.10.2020, passed by the learned Civil Judge 1st Class, Islamabad-East, available at Page-15, being impugned through instant writ petition.
3. Perusal of order ibid reveals that after framing issues, the application has been set for recoding of evidence.
Thus, has not been finally decided, therefore, for all intents and purposes, instant writ petition is pre-mature. The petitioner , may agitate all his grievances before the court, seized of the application . Dismissed in limine .
