The applicant by way of instant Revision Application has impugned order dated 15.12.2020 passed by learned Ist Additional Sessions Judge (MCTC), Sanghar , whereby his application for adjournment has been dismissed.
2. It is contended by learned counsel for the applicant that the dead body of the deceased has been exhumed to determine actual cause of his death therefore, learned trial Court ought to have dismissed the adjournment application of the applicant.
3. Learned A.P.G for the State and learned counsel for the private respondent have sought for dismissal of the instant Revision Application by contending that the learned trial Court by dismissing adjournment application has committed no wrong which could be made right by this Court.
4. I have considered the above argument and perused the record.
5. Order whereby an application for adjournment has been dismissed could hardly be made a subject to its examination by this Court in its revisional jurisdiction. Consequently , the instant Criminal Revision Application being misconceived is dismissed accordingly .
6. However , it is expected that learned trial Court would consider the opinion of the medical board determining the actual cause of death of the deceased in accordance with law while making final disposal of the case.
