Through the instant petition, the petitioner has called in question the office order dated 05.4.2018 issued by the respondent-Sindh Madressatul Islam University , whereby his services were terminated during probationary period on the premise that before the impugned action he was condemned unheard in violation of Article 10-A of the Constitution, though he was regular employee, no regular enquiry was conducted to probe the purported allegations levelled against him.
2. Both the parties after arguing the matter at some length seek disposal of this petition in the terms of office order No. SMIU/HRM/OO-RES/2021- a draft of which has been provided by Mr Metlo to the petitioner and a copy placed on record.
3. In view of the above consensus between the parties, this petition stands disposed of along with the pending application(s), in the above terms, resul tantly , the impugned termination order dated 05.04.2018 issued by the respondent university is set aside; and, the same is converted into his resignation from the post of Office Superintendent (BPS-16 Higher Time Scale-17) service with ef fect from 05.04.2018.
