The case of the Petitioner is that he was recruited on the post of Scientific Officer with the subject applied Chemistry , having required qualification of M.Sc; and he had served in the Project about four years thereafter after ending of the Project the employees working in the Project were considered and regularized by the competent authority , however petitioner was not considered, accordingly petitioner approached this Court on the point of discrimination thereafter directions were issued for reconsideration of the Petitioner 's case in the year 2007. The Board meeting was held to consider the qualification and performance of the petitioner alongwith other employees who were working with him on same Batch, some of them were considered, the petitioner was not considered.

Admittedly post of Officer is lying vacant and representative of the respondents contends that in the year 2007 Board meeting was held and petitioner was provided an opportunity but he failed to qualify . Whereas in the year 2010 and 2011, he remained absent. At this juncture petitioner contends that required qualification was applied Chemistry therefore the Board was required to provide him an opportunity while conducting test within the subject that was applied Chemistry , but that exercise was not undertaken as respondents conducted test from the Chemistry Subject.

Accordingly , as an indulgence, with last chance we direct the respondents that they shall constitute a fresh Board comprising of recruitment committee/Board and they shall conduct test in the applied Chemistry as well as provide ample opportunity to the Petitioner for an interview and shall pass a speaking order with regard to his regularization in case if he qualifies shall be accommodated within two months. It is pertinent to mention here that recruitment committee shall also examine the cases of the persons/employees who were batchmats of the petitioner were regularized; petitioner shall also be treated one same anology .
4. The Constitution petition stands dispo sed of. Let copy of this order shall be communicated to the concerned authority for compliance.
