1. Muhammad Ali Mazhar , J. The petitioner has prayed for the directions against respondents No.1 and 2 to suspend/recall the order dated 18.09.2019 for cancellation of arms licence of the petitioner and issue directions to the Home Department to issue fresh licence to the petitioner .
2. Learned Assistant Advocate General invited our attention to the comments. The cancellation letter dated 18.09.2019 shows that on the request of Respondent No.3 (Ex-Commissioner/Pr oject Director Afghan Refugees Sindh), the competent authority was pleased to cancel/revoke arms licence dated 16.06.2017 issued in favour of Abdul Aziz. One more letter is available on record with the reply dated 17.09.2019 which was communicated by Ex- Commissioner / Project Director Afghan Refugees Sindh to the Home Department wherein it was stated that a licence of non-prohibited was issued at his request in the name of Abdul Aziz. Since he was transferred from the post of Commissioner/Project Director therefore he made a request for cancell ation of arms licence. Learned Assistant Advocate General argued that the licence was issued on the request of Ex-Commissioner in favour of petitioner to perform his official duties and after his transfer , he himself made a request for the cancellation which was done by the Home Department. Learned Assistant Advocate General further argued that if the petitioner will apply for the fresh arms licence, his application will be considered by the Home Department in accordance with law. On this statement, this petition is disposed of accordingly alongwith pending application. revisions by the competent authorities.
