1. At the very outset learned counsel for the petitioner submits that the petitioner has been retired from his service on attaining the age of superannuation vide Notification dated 2nd October 2007, which is available in case file at page-103.
2. The main grievance of the petitioner is that though he has been retired from Auqaf Department without due promotion and when the D.P.C was convened he was eligible for the same and his juniors were promoted, but he has not been given promotion, therefore, prays for proforma promotion.
3. Learned Additional Advocate General, Sindh submits that since the petitioner has been retired almost ten years back, therefore, he is not entitled for any relief, as the petition suffers from principle of latches, which has not been properly explained by the petitioner in this petition.
4. We have seen case file minutely . It is stated by learned counsel for the petitioner that one Muhammad Saleem Shaikh, who was junior to the petitioner was promoted rather he qualified for the same, but he could not be given due promotion; however , he submits that he would be satisfied and would not press this petition if, his case be sent to competent authority for redressal of his grievance under the Law .

In view of above, this petition stands disposed off with directions to the petitioner to make proper application for redressal of his grievance before concerned Authority and after filing such application the competent authority shall decide the same after hearing the petitioner as per Law within thirty (30) days independently under intimation to this Court.
