Learned counsel for the petitione r submits that pursuant to Order-in-Or iginal No.01/30 of 2019 dated 20.09.2019 passed by the Deputy Commissioner Inland Revenue, Unit-01, Zone-III, LTU-II, Karachi, petitioner has filed an appeal alongwith stay applicati on before Commissioner Inland Revenue (Appeals-IV), LTU, Karachi, however , no order has been passed thereon, whereas, respondents have initiated proceedings for the recovery of impugned demand by adopting coercive measure, hence requests that respondents may be restrained from enforcing the recovery of impugned dema nd/notice dated 16.11.2020 till final decis ion of the appeal pending before Commissioner Inland Revenue (Appeals-IV), L TU, Karachi.
Let pre-admission notice be issued to the respondents as well as D.A.G, to be served through first three modes, for a date to be fixed after two weeks, when comments, if any, shall be filed with advance copy to the learned counsel for petitioner . However , till next date of hearing, respondents shall not enforce the recovery of impugned demand/notice, which is subject matter of appeal pending before Commissioner Inland Revenue (Appeals-IV), LTU, Karachi.
