1. Muhammad Ali Mazhar , J. Precisely , the petitioner has challenged Notification dated 15.03.2019 available at Page 57 issued by the Director General Coal, Directorate of Coal Mines Development, Government of Sindh whereby on the recommendations of Coal Mines Com mittee and with approval of licensing authority the mining permit granted to the petitioner for the period of five years with effect from 17.02.2007 to 16.02.2 012 was treated expired/invalid w.e.f. 17.02.2012 but the fact remains that this cancellation letter was issued after the lapse of considerable period.

Learned counsel for petitioner has pointed out Page 59 which is memo of appeal and argued that before action of termination/cancellation of contract an appeal was filed before the Secretary Energy Coal Department Government of Sindh Karachi for renewal of permit which is pending and without any decision notification of cancellation was issued. Mr. Shahzad Muzaf far Qadir Assistant Director Coal Mines is present and admitted that the appeal is pending before the Secretary Energy Coal Department. Learned Addl.A.G. has proposed that some directions may be issued to the Secretary Energy Coal Department to decide the appeal expeditiously so that matter may be set at rest. The petition is disposed of with the directions to the Secretary Energy Coal Department, Government of Sindh Karachi to decide pending appeal within a period of 20 working days after providing ample opportunity of hearing to the petitioner .
