On Court query learned counsel for the petitioner has failed to satisfy this Court as to how the impugned order , which has been passed by Civil Judge & Judicial Magistrate-I Digri, can be assailed through this constitution petition although remedy is available to him to challenge the said order before the concerned District and Sessions Judge. Accordingly , instant petition is dismissed alongwith listed application.
