ADNAN-UL-KARIM MEMON, J. Through this Petition, the petitioner is seeking issuance of writ of Habeas Corpus directing the respondents - police officials , to produce her daughter namely Komal @ Erum Marry who is allegedly detained by her father .
2. Per learned counsel the Petitioner married with Respondent No.3 in 2014; after some time of marriage the relationship between the spouse were strained, hence the Petitioner along with her daughter left the house of Respondent No.3 and filed Family Suit for Judicial Separation, Maintenance and Recovery of Dowry Articles before Family Judge No. VIII, Hyderabad which annoyed Respondent No.3, hence he came at the house of her parents and took away her minor daughter namely baby Komal @ Erum Marry .
3. Today minor namely baby Komal @ Erum Marry has been produced in court, her custody is handed over to the Petitioner-mother . This Petition has served its purpose which is disposed of accordingly . However , Respondent No.3 is at liberty to approach learned Guardian and Wards Court concerned for the custody of minor , however , if approached the same shall be decided within a reasonable time.
