2to4. Learned counsel for the petitioner has been heard on the point involved in this petition. It is noted that controversy agitated in this petition appea rs to be disputed facts which can only be resolved through evidence for which remedy is available to the petitioner . During course of arguments, we have specifically asked the question to the learned counsel for the petitioner that how this petition is maintainable when the remedy is available either to file Civil Suit or to make a proper application before concerned forum for redressal of his grievance, he has no answer with him.
In view of the above, this petition stand s disposed of. However , petitioner shall be at liberty to approach the concerned forum for redressal of his grievance, if so advised, as per law .
