1. The applicant by way of instant Crl.Misc.Application under section 491 Cr.PC has sought for production of Mst.Sindhu alleged to be his wife before this Court, and then to be set free after recording her statement, as she according to him is confined illegally by the private respondents.
2. Mst. Sindhu, the alleged detenue is produced by the private respondents throug h SHO, Police Station, Hassan Wahan, on query , it is stated by her that she is not married with the applicant and is residing happily with her parents. By stating so, she denied allegation of her wrongful confinement, on the part of private respondents. Her statement to that ef fect has also been recorded by SHO, P .S, Hassan W ahan, which is taken on record.
3. The circumstances indicate that Mst.Sindhu is under no wrongful confinement to be set free by this Court, in favour of the applicant by way of instant Crl.Misc.Application, it is dismissed accordingly .
