FAHIM AHMED SIDDIQUI, J.---The petitioners through the instant petition are seeking quashment of proceedings of FIR No, 278 2016 under sections 364-A and 506, P.P.C. lodged at Police Station Dadu by the respondent No, 7 against the petitioners and their other family members. It is alleged in the said FIR that the petitioners have abducted their daughter baby Amna.
2. Succinctly, the facts of the case as per a memo of the petition are that respondent No, 6 (Mst.
Farzana) is the real sister of petitioner No, 2 (Mst. Safiyat) while respondent No, 7 (Ghulam Muhammad) is the second husband of respondent No,
6. Baby Amna daughter Mumtaz Ali Shaikh was born to respond and No, 6. from her previous husband who was handed over to petitioner is Nos, 1 and 2 for adoption and they adopted her as their daughter and since then she is in their custody and now she is 12 years of age. It is alleged that now the second husband of the respondent No, 6 is inclined to get the custody of minor Amna with intention to sell her against the monetary considerations. For the same reason, he pressurized respondent No, 6 and succeeded in getting an order from the learned ex-officio Justice of Peace and subsequently lodged withthe aforementioned FIR.
3. Arguments heard and available record perused.
4. At the time of hearing, both the parties were present in the court along with minor Amna. We have observed that the minor is very much attached with petitioners Nos, 1 and 2. The respondent No, 6 was asked whether petitioner No, 2 is her real sister to which she replied in affirmative.
Apparently, it is a dispute of custody of minor which has been given a colour of criminal proceedings with the intention to pressurise the petitioner party. It is hard to believe that such close relatives would have abduct with bad intention. We have already taken judicial notice that the minor is very much closed and attached with petitioners Nos, 1 and 2 as well as other petitioners. In these circumstances, we are of the considered view that a case of quashment has been made out as such are the proceedings in respect of FIR No, 278/2016 under sections 364-A, 506, P.P.C. lodged at Police Station Dadu are quashed. The petitioners and respondents are at liberty to approach the concerned forum regarding the custody of minor baby Amna, if so advised.
