1. The matter has been heard at length today and with the consent of the learned counsel for the parties the instant petition is disposed of in the following manner:- 1) Since the very appointment of the petitioner as Liaison officer in BPS-18 in Sindh Agricultural Supplies Organization Government of Sindh (SASO) has been called in question by raising an objection by the respondents.
2. We direct the Chief Secretary , Government of Sindh to take up/ enquire this issue and decide the same in accordance with law by dilating upon the issue whether the very appointment of the petitioner in Grade-18 in
(SASO) was in accordance with the Law, Rules and Regulations, and the same has been made by the competent authority after fulfilling all the legal and codal formalities in this behalf or not after granting Petitioner a meaningful hearing. The Chief Secretary Sindh while considering the case of the petitioner would specifically keeping in view the directions given in Para No.20 of the C.P No.D-965/2016 and C.P No.D-6498/2014 dated 25.01.2018, the relevant paragraph for convenience is reproduced herein below:- "20. In the wake of above discussion, the aforementioned Constitution Petitions are disposed of in the following terms along with pending application(s):- Government of Sindh / Competent Authority is directed to take decision whether petitioner 's initial appointment in (Defunct) SASO is as Junior Clerk in BPS-5, now in BPS-1 1 or as Assistant in BPS-1 1.
(a) The Competent Authority to pass an appropriate order as provided under Rule 9-A of Sindh Civil Servants (Appointment, Promotion and Transfer) Rules 1974, and the dicta laid down by the Hon'ble Supreme Court of Pakistan in the case of Ali Azhar Khan Baloch & others vs. Province of Sindh & Others [2015 SCMR 456], after granting Petitioner in C.P No.965 of 2016 a meaningful hearing within a period of two months.
3. 2) It is expected that the said exercise would be completed by the Chief Secreta ry Sindh within a period of two months from the date of receipt of this order . With these directions the instant petition stands disposed of. Let a
