' S. ABDUL JABBAR KHAN (CHAIRMAN).-Muhammad Rashid Khan has filed this appeal under section 4 of the Punjab Service Tribunals Act, 1974, against the order dated 3rd June, 1978, passed by respondent No, 1, whereby services, of the appellant, were terminated and appellate order dated 16th May, 1981, by which his appeal was dismissed. By virtue of this appeal he had prayed that the impugned order may be set aside and he be re-instated in service.

Brief facts of the case are that the appellant while posted as Junior Clerk at DHQ Hospital, Bahawalnagar was charge-sheeted on a number of counts which pertained to various dates in the year 1978, viz. Quarrelsome behaviour use of unsocial and unparliamentry language including abuses with Dr. Wahid Bakhsh Bhatti, Medical Officer, DHQ Hospital, Bahawalnagar, with Mr. Muhammad Jamal, Laboratory Assistant and disobedience of the orders of Deputy Director Health Services by throwing the same and leaving the office by giving threatening warnings and using abusive language. It was also a complaint against him that he did not hand over the charge, in spite of clear-cut directions and instead locked up almirah with record. It was also alleged against him that he was organizing destructive plans and his behaviour with the staff and public remained rude and impolite the appellant has stoutly resisted all the allegations in his appeal. Parawise comments were called for from the M. S. DHQ Hospital, Bahawalnagar and were perused in entirety.

I have also heard the appellant in person as well as the learned District Attorney and have perused the record in this case minutely to determine whether the appeal is fit for regular hearing or not. In this connection I have also relied on the personal file of the appellant which was produced before me at the time of hearing. What I find is, a bleak picture of the appellant's conduct throughout his service career and I am fully convinced that a person like him would hardly be fit person, to be retained in service, The record is full of his activities which can hardly be considered conducive to the discipline, good order and cooperation which are sine qua non of the service discipline and manners required for a civil servant. The appellant in this case was given a chance to defend himself but as per the old proverb that all the roads lead to Rome. All the enquiries in this case lead to one inescapable conclusion that he had made his life as well as life of others most miserable by his bad conduct, quarrelsome nature and disobedience in all manners. The appellant when confronted with this situation threw an open challenge to the respondents who happened to be present in the Court that if he takes oath on Holy Quran that he grappled with the Dr. Wabid Bux Bbatti, Medical Officer DHQ Hospital, Bahawalnagar and committed all other acts, he would not press for his appeal. The challenge was accepted and the respondents, confirmed all the circumstances acts and of the appellant.

4. In view of the above I do not find any justification to admit this appeal to regular hearing and proceed to dismiss the same in fimine, as being without any merits.
