I. LAW COLLEGES COMMISSION: Mr. Ishtiaq Ahmad, Member Pakistan Bar Council submits that the aforesaid Comm ission could not be constituted because the Committees of the Pakistan Bar Council have become non functional due to the litigation pending before the august Supreme Court of Pakistan. Considering that this issue is important and affects a large number of law students, we hereby appoint Mr. Ishtiaq Ahmad, Member Pakistan Bar Council as a representative of the Pakistan Bar Council in the "Law Colleges Commission" . Similarly , we appoint Rana Intezar Hussain, Member , Punjab Bar Council as a representative of the Punjab Bar Council in the aforesaid Commission. The reconstituted Law Colleges Commission is as follows:-
(1) Advocate General Punjab (or his nominee where required) - Chairman of the Commission;
(2) Mr . Ishtiaq Ahmad (Representative of the Pakistan Bar Council) - Member;
(3) Rana Intezar Hussain (Representative of the Punjab Bar Council), Member;
(4) Commissioner/District Coordination Officer (according to the concerned Division and District as the case may be);
(5) CCPO/DPO (according to the district concerned).
The aforesaid Commission shall hold its first meeting under the Chairmanship of Advocate General Punjab on 20.12.2016 at 11:00 a.m. The Commission shall do the following:-
(i) Verify by carrying out physical inspection whether the affiliated law colleges fully comply with the requirements of af filiation as per law;
(ii) Verify and prepare a list of tuition centres imparting legal education without affiliation in the Punjab. The first report in this regard be placed on the record before the next date of hearing.
II. SYLLABUS:
2. Learned counsel for one of the private colleges submit that Bahauddin Zakariya University ("BZU") has not approved the syllabus for 5 years LL.B. Programme. Learned counsel for the concerned University submits that they are awaiting approval of the Pakistan Bar Council. Learned representative of the Pakistan Bar Council submits that said syllabus has already been approved in the case of University of the Punjab and it is the same syllabus that will be followed in all the Universities of the Punjab, hence, BZU need not wait any further and circulate the syllabus for the LL.B. 5 years programme as approved by the Pakistan Bar Counc il and adopted by the University of the Punjab. Order accordingly .
III. ALLOCATION OF SEATS/MORNING CLASSES
3. It is clarified that 100 seats prescribed under the Pakistan Bar Council Legal Education Rules, 2015 shall not be put into operation till final disposal of this petition and in the meanwhile as already provided in orders dated 19.09.2016 and 24.10.2016 the seats already granted to the affiliated colleges (inclusive of morning and evening classes) at the time of affiliation shall be the seats utilized for the purposes of 3 years LL.B. programme, as well as, 5 years LL.B. programme. It is clarified that as per the Pakistan Bar Council Legal Education Rules, 2015 and the Notifications issued by the respective Universities, there will be no evening classe s. Any admissions granted over and above the allocated seats will be in violation of these orders, therefore, any admissions granted in this regard may be reconsidered by the respective Universities, as well as, Law Colleges.
IV. AGE
4. As an interim measure, it is further clarified that age limit alone is no bar for the purposes of enrollment in the LL.B. 5 years programme or 3 years LL.B. programme, however , if a candidate has already done his B.A. he will be considered in the LL.B. 3 years programme. Therefore, anybody over and above the age of 24 years without holding a B.A. degree is provisionally eligible to apply for LL.B. 5 years programme.
V. AFFILIATION
5. It is pointed out by the learned counsel for the respective Universities that even to commence the LL.B. 5 years programme respective Law Colleges require fresh affiliation and in this regard the process is under way. The respective Universities/Law Colleges are directed to complete the process of affiliation for the purpose of granting admissions in 5 years LL.B. programme within a period of one month from today . It is clarified that in case where such affiliation is declined any admission s made in this regard will not be in acco rdance with law. While granting fresh affiliation for the 5 years LL.B. progr amme the Universities will reconsider the number of seats to be allocated to the respective College as per the Affiliation Rules and the University Calendar .
6. The earlier orders passed in this case shall be read into all the connected matters.
7. To come up for arguments on 17.01.2017.
VI. DIRECTION TO THE OFFICE:
8. As this order will have a bearing on a large number of law students studying in Punjab, office is directed to disseminate this interim order through media and place it on the website of this Court so that respective students are apprised of the legal position.
