1. ' Mr. Muhammad Suhail Zafar Bhatti has filed vakalatnama for the respondent No.5 alongwith parawise comments. Mr.Wasique Ahmed Kehar has also filed vakalatnama for the respondent No.6 and 8. SHO Inspector Hayatullah Khan, PS Gulistan-e-Johar, present in court, has submitted comments. Copy has been supplied to counsel for the petitioner. Basically in this petition, controversy relates to the title of land in question i.e., Plots Nos.810, 811, 828 and 829, for which the petitioner has filed few documents which were issued to him by Anjuman Falah-o-Behbood Bashindagan-e-Chishti Nagar Goth. The petitioner has also made Mumtaz Channa, Assistant Commissioner (Revenue) as respondent No.5 in the petition and argued that he tried to dispossess the petitioner from the land by using his official position. The respondent No.5 has filed counter affidavit alongwith two documents including. Allotment Letter/Sanad issued by the Board of Revenue, Government of Sindh, in relation to Survey No.828 and 829. He has also attached some copies of paid challans to show that the said plots are owned by him. Learned counsel for petitioner submits that so far as the title of land is concerned, the petitioner has already filed a suit in this court and he has stated at bar that some restraining order has already been passed by learned Single Judge at Original Side of this court. However, he submits that other reliefs relating to harassm ent, protection and action in accordance with law, may be granted to the petitioner. SHO has submitted comments in which he has shown to have recorded statements of six persons who have disputed title of petitioner. When the petitioner has already filed a suit in this court for resolution of title/dispute, the A same will be decided by this court in the civil suit as in the constitutional jurisdiction, we cannot entertain the disputed questions of facts and or factual controversy for which petitioner has already availed proper remedy. So far as harassment is concerned, naturally nobody can be harassed and action is to be taken by government functionaries and police department against any person strictly in accordance with law. So in future no harassm ent shall be caused to petitioner by the respondents. Petitioner may also approach to concerned PS for protection and the concerned SHO will provide protection in 'accordance with law. Petitioner on the last date of hearing also pointed out that one boy Shaukat son of Khadim Hussain was also taken into custody. In this regard SHO submits that no such incident has taken place. Father of missing boy may approach to concerned SHO and the SHO shall record statement of Khadim Hussain for missing of his son Shaukat and he will take necessary action for recovery of missing boy and also lodge the FIR. If petitioner has any other grievance, he is at liberty to approach concerned SHO who will take action in accordance with law. Petition is disposed of along with listed application.
