' KHADIM HUSSAIN M. SHAIKH, J.---It is the case of the petitioner that he is nephew of deceased Dodo Khan son of Muhammad Ishaque who while performing his duty as Head Constable in Sindh Police, was murdered in an encounter with dacoits on 10.11.2002 in the jurisdiction of Police Station Bhit Shah. He, therefore, requests that petitioner may be appointed as Police Constable on "Shaheed Quota" policy. In paragraph No,4, it is averred that father of petitioner SIP Rehmatullah Saddar is serving in Sindh Police since 1980.

Record reflects that on 04.02.2016 during the course of hearing it was pointed out by Mr. Amjad Shaikh, Senior Superintendent of Police, Matiari District that the petitioner Saifullah has two CNICs, one of which was filed by him along with his application showing his date of Birth as 05.06.1981 and other one was filed by him in this petition showing his Date of Birth as 05.06.1986 and thereby the petitioner tried to mislead this Court by concealing his real and actual age; he further stated that the petitioner by committing forgery and interpolation in his CNICs, has committed an offence. In the wake of such submission of S.S.P Matiari, copies of both the CNICs of the petitioner were sent for verification to NADRA in order to ascertain the authenticity and genuineness thereof vide an order dated 04.02.2016. In pursuance of the said order NADRA SRHO Hyderabad has submitted its report bearing letter No, NADRA/ Ops/ 16/ Ver/ 659, dated 19.02.2016 which reads as under.
"It is submitted that throughout only one CNIC bearing No,41305- 3193637-0, is issued to Mr. Saifullah which discloses his Date of Birth as 05.06.1986. Previously, the same CNIC No,41305- 31936370, was issued to him in the year 2002 vide form #HD00005189, having his Date of Birth as 05.06.1981.
' Whereas, mentioned applicant applied for partial name correction dated 16.04.2012 from NRC Matyari and no any change in DOB was made. However, he modified his Date of Birth in his CNIC upon submission of his own application bearing TID No,103541023248 dated: 22.01.2013, after proper verification his antecedents from concerned department and payment of Rs,5300 legal fees of NADRA for such correction, he was issued modified CN1C having DOB 05.06.1986 dated 20.01.2016.
' The comparison of both the copies of CNICs so provided by your A Honour infers that back page of both the copies is same hence seems managed and crafted by the applicant himself. The report in view of above position is submitted as desired please."

Learned A.A.G. has placed on record the copies of School Leaving Certificate of Government Primary School Umer Sadar, School Leaving Certificate issued by the Government Higher Secondary School Odero Lal Station District Matiari and School General Register, which all show petitioner's Date of Birth as 05.06.1981. Moreover, copy of the letter No, B1SE/SSC/PACCA/3939 dated 22.02.2016, issued by the Controller of Board of Intermediate and Secondary Education Hyderabad addressed to the Superintendent of Police District Matiari filed with the comments of respondents No,4 reads as under:-- "BOARD OF INTERM EDIATE AND SECONDARY EDUCATION HYDERABAD"

' SUBJECT: VERIFICATION OF MATRIC CERTIFICATE "OF SAIFULLAH SADAR SEAT NO.05312 .
' With reference to your letter No,PB/508 dated 11.2.2016 I am to inform you that the certificate No,A893532 issued on 18.5.2003 send by you is found bogus. However in this office record the candidate Mr. Saifullah son of Rehmatullah, Sadar Seat No .05312/ Supple-mentary/2001 date of birth is 05.06.1981 (Date of birth fifth June N/H Eighty one) is failed and Pacca Certificate can not be issued.

Confronted with the above position, learned advocate for the petitioner has not been able to controvert the allegations against the petitioner regarding his above unlawful acts in preparing bogus Matriculation Certificate and also making forgeries in his CNICs by changing his date of birth from 05.06.1981 into 05.06.1986 therein; and thereby the petitioner has rendered himself liable to be dealt with according to the law. As the petitioner has wasted the time of the Court in this frivolous petition, which is pending since 02.10.2013, therefore, the, petition is liable to be dismissed with heavy costs.

Above are the reasons of our short order dated 25.02.2016 whereby this petition was dismissed with costs of Rs,25,000 with direction to S.S.P Matiari to take action against the petitioner Saifullah son of Rehmatullah in accordance with law and to submit compliance report to the Additional Registrar of this court.
6. The petitioner is directed to deposit the above amount of Rs,25,000/- with the Additional Registrar of this Court within 60 days of this order without fail. The said amount shall be utilized for Library of Circuit Court Hyderabad.
