1. This order shall dispose of Appeal No. 57 of 2009 filed under section 33 of the Securities and Exchange Commission of Pakistan Act, 1997 against the order dated 12/08/09 (the "Impugned Order") passed by the Respondent. The appeal was fixed for hearing previously on 9/4/10, 4/7/11, 22/3/12, 19/9/12 and 8/2/13 and as per record on all these dates of hearing either adjournment was sought or no one appeared on behalf of the Appellant. The appeal was re-fixed for hearing on 19/02/15 and a final opportunity of hearing was afforded to the Appellant. The appeal was called for hearing at 3:40 pm; the department representative was present, however, no one appeared on behalf of the Appellant before the Bench and no request for adjournment was received by the Bench. The matter was kept pending till the close of official timings however the Appellant failed to appear despite repeated calls. From the conduct of the Appellant it appears that it is not interested in pressing the present Appeal, therefore, the Appeal is dismissed for non-appearance and non- prosecution.
