1. This order shall dispose of appeal No. 62 of 2009 filed under section 33 of the Securities and Exchange Commission of Pakistan (the "Commission") Act, 1997 against the order dated 06/10/09 (the "Impugned Order") passed by the Respondent. The appeal was fixed for hearing previously on 09/04/13 which was adjourned on the request of the Appellant's Counsel. The appeal was re-fixed for hearing and final opportunity was provided to the Appellant to appear and defend the case on 03/02/15. The appeal was called for hearing at 11:20 am; the department representatives were present, however, neither the Appellant nor the Respondent No.2 appeared before the Bench and no further adjournment was sought by either parties. The appeal is, therefore, dismissed for non- appearance and non-persuasion.
