A representation made by Mrs. Farah Ghafoor, an aggrieved shareholder of Dandot Cement Company Limited (DCCL), against an order (impugned order) dated 3rd October, 2000 of the then Commissioner (SM) of the Commission was converted into an appeal came up for hearing on 15th February, 2001. When "it was decided to ascertain from the lady complainant as to whether she is interested to press her complaint."

2. Mr. M. Saleem Sahgal, Advocate alongwith Abdul Jabbar Butt, General Manager, Corporate and Legal Affairs of DCCL appeared on 30th May, 2001, the date parties were called for a hearing.

3. Mr. M. Saleem Sahgal reiterated that the lady complainant Mrs. Farah Ghafoor has withdrawn her representation by her letter dated 26th October, 2000 thereby rendering the proceedings infructuous

4. A copy of the order of the Appellant Bench No. 3 dated 15th February, 2001 was sent to the lady complainant by registered A.D. which was returned back undelivered bearing the remarks "that the addressee refused to receive the letter." Thereafter notices issued by the Commission on 11th April, 2001, 16th April, 2001 and 24th May, 2001 were not received by the lady complainant and were returned undelivered.

5. It appears that the lady complainant has lost her interest in pursuing her complaint and her withdrawal is genuine.
