' Through this constitutional petition, an order dated 15.4.2010 has been assailed which was passed by learned Ex-Officio Justice of Peace, Jaranwala, District Faisalabad directing initiation of criminal case against the petitioner.

The petitioner is a police official and being an Investigating Officer of case FIR No, 882 dated 13.12.2009 he had recommended the said case for cancellation, which report was agreed upon by the concerned authorities giving rise to filing of an application under Section 22-A, Cr.P.C. Against the petitioner.
3. After having heard the learned counsel for the parties and perusing the record it is found that the petitioner had performed his duties in accordance with law being a police official. Even otherwise, his official acts are not liable for prosecution, which fact has not noticed by the learned Ex-Officio Justice of Peace while making direction for registration of the case against the petitioner, so the order passed by the learned Ex-Officio Justice of Peace is liable to be set aside.
4. For the foregoing reasons, the petition in hand is accepted and the order impugned is set aside- resulting into dismissal of the application filed under Section 22-A, Cr.P.C.
