' Petitioner Muhammad Faryad has sought his post arrest bail in case FIR No, 08 dated 07.01.2015, offence under Section 376(i) of The Pakistan Penal Code, 1860, registered at Police Station Saddar, District Lodhran.
2. Prosecution case in brief is that on 21.12.2014 complainant went to ease herself outside her house where petitioner alongwith two unknown persons came and threatened her. Petitioner then committed rape with her whereas two unknown persons stood as guards.

4. Record in this case shows that the occurrence took place on 21.12.2014. The alleged victim Sajida Bibi was medically examined on 22.12.2014 at 09.00 p.m. According to lady doctor a young married woman pregnant of 8-months gave history of sexual assault one day before. No injury on her person was noted. Record further shows that the alleged victim was herself involved in a criminal case and she also filed a writ petition for quashment. Even otherwise story narrated by the complainant does not sound logical. If she was carrying pregnancy of 8-months, commission of rape with her would have resulted in serious consequences like miscarriage. In the light of material collected and facts available on record guilt of petitioner needs further probe and his case calls for further inquiry. Accordingly, this petition is accepted and the petitioner shall be released on bail subject to his furnishing bail bonds in the sum of Rs, 2,00,000/- with one surety in the like amount to the satisfaction of the learned trial Court.
