' Petitioners namely Muhammad Akbar, Muhammad Ajmal and Muhammad Salman seek pre- arrest bail in case F.I.R. No, 144 dated 10.02.2014 under Section 452/337-A(ii) P.P.C. Registered at Police Station Saddar, Bahawalpur.
2. As per contents of the F.I.R. The petitioners caused injury to the complainant with their respective weapons of offence.
3. Learned counsel for the petitioners inter-alia while reiterating the grounds given in the bail application prayed for grant of bail.
4. Conversely, learned Law Officer assisted by learned counsel-for the complainant vehemently opposed the bail petition.

6. As per contents of F.I.R. Specific allegation against' Petitioner No, 1 Muhammad Akbar of inflicting injury on the head of the complainant with iron rod has been leveled. He is specifically nominated in the F.I.R. Injuries mentioned in the Medico Legal Certificate are in line with the version of the complainant as alleged in the F.I.R. Against Petitioner No, 1 Muhammad Akbar. Learned counsel for the Petitioner No 1 has failed to demonstrate mala fide or ulterior motive on part of the complainant to falsely implicate Petitioner No 1 Muhammad Akbar in this case. Resultantly, this petition to the extent of Petitioner No, 1 Muhammad Akbar is dismissed.

As far as, the case of Petitioners No, 2 and 3 namely Muhammad Ajmal and Mohammad Salman is concerned, general allegation has been leveled against the said petitioners of inflicting injuries on the person of the complainant with their respective weapons of offence. No specific injury has been attributed to any of the petitioner. In Medico - Legal Certificate, there is only one injury mentioned at the head of the complainant which was caused according to the contents of the F.I.R.
By Petitioner No, 1 Muhammad Akbar. The Medico Legal Certificate of the complainant is in conflict of his oral version as mentioned in the F.I.R. Resultantly, mala fide and ulterior motive on the part of the petitioner to falsely implicate these two petitioners in this case cannot be ruled out.

In view of the above, this petition to the extent of Petitioners No, 2 and 3 namely Muhammad Ajmal and Mohammad Salman is allowed and pre-arrest bail already granted to them is confirmed subject to their furnishing fresh bail bonds in the sum of Rs, 1,00,000/- each with one surety each in the like amount to the satisfaction of learned trial Court.
