' AAMER FAROOQ, J. --- This is an appeal against order dated 30.12.2014 passed by respondent No, 1 whereby the review application filed by the appellant was dismissed.
2. The grievance of the appellant is that she applied for the post of Assistant Headmistress and successfully passed the written test as well as interview. On 07.10.2013, the appellant was informed that she has been pre-selected for interview, however, she was asked to provide certain documents. On 29.11.2013, the appellant was informed that there is an objection regarding the letter granted by Prime Minister whereby her age was relaxed under Relaxation of Upper Age Limit Rules, 1993. In March, 2014, the appellant appeared for interview, however, on 09.052014 the candidature of the appellant was rejected due to her being over aged and she was asked to provide specific order from the Prime Minister for age relaxation. The appellant filed representation before the Commission and submitted that the age relaxation order was granted by the Prime Minister under the above-mentioned rules. The respondents in July, 2014 sent a letter for confirmation to the Prime Minister's office for the age relaxation order/letter. Subsequently, the appellant was informed that her candidature has been rejected as she is over aged. The appellant filed review petition before the Chairman, Federal Public Service Commission (FPSC) which was also dismissed on 08.01.2015.

The learned counsel for the appellant, inter alia, submitted that as required by the respondents the appellant provided the age relaxation letter duly issued from the office of Prime Minister and in light of the same all codal formalities stood completed, therefore, the rejection of candidature of the appellant, on the ground of being over aged, is nottenable.
4 The representative of FPSC namely, Moazam Abbas, Assistant Director, appeared in the Court and submitted that a' letter was sent to the Prime minister's office for verification of letter granting age relaxation to the appellant and in response thereto vide letter dated 09.12.2014 the Commission was informed that no approval for age relaxation was granted to the appellant.
5. The sole controversy in the present appeal pertains to the issuance of approval for age relaxation by Prime Minister's office and a subsequent letter whereby the above letter was not verified. Since the earlier letter has not been confirmed by the Prime Minister's office, therefore, the fact remains that the Prime Minister under the Relaxation of Upper Age Limit Rules. 1993 has not granted formal approval to the appellant and she is over aged for the post in question, for which reason she was not selected.
6. In view of above, there is no legal infirmity in the impugned order and the appeal is dismissed.
