1. Contention of claimant in brief is that his brother sent some amount from Canada in his account being maintained with respondent's Bank at Model Town, Katchary Road, Khanpur.
2. On 5.3.14 Bank Officer Mr. Tariq informed the claimant telephonically that an amount of 10,000/- Canadian Dollors has been received in his name, so he may visit the Bank.
3. He at once visited the Bank and signed necessary documents which the Bank Manager asked him to sign.
4. He was told that the amount will be deposited in his account within a few days after performing the formalities. The prevailing rate of Canadian Dollors on that day was Rs.94.56 per Dollor. On 7.3.2014, he again contacted the Bank Officer Mr. Tariq telephonically at which he told that amount has been transferred in his account. On 08.03.2014, when he checked balance, it disclosed that amount has not yet been transferred in his account. He at once contacted the Bank Manager at which he apologised and stated that amount will be transferred in his account till 10.03.2014.
5. On 10.3.2014, the amount was transferred but at the rate of Rs.91.56/- per Dollor. In this way, a loss of Rs.25, 500/- was to be borne by the claimant.
6. This loss occurred due to "Faulty Service" of the respondent, so they were served with a legal notice but respondents did not bother.

That reputation of claimant in business community suffered badly due to non deposit of this money in his account because he could not make payments due to want of money and for that matter he claims Rs.20,00,000/- as compensation for the mental agony and loss of business with recovery of Rs.25,500/- which was the loss which he suffered due to "Faulty Service" of the respondent.

Due legal notice was served to the respondent and he put appearance through Zafar Iqbal Manager Bank Al-Habib Model Town, Katchary Road, Rahim Yar Khan on 18.11.2014 and they were provided six opportunities to submit their written statement but they failed even to appear on 2.3.2015, 24,3,2015 and 13,4,2015 at which they were proceeded against Ex-Parte and their right to submit written statement was struck of.
9. Claimant has submitted his affidavit as his evidence in support of his version.

11. From careful perusal of record, it is found that it is a matter of record and Bank was supposed to submit the record to contradict the version of claimant in which Bank failed badly.

It is clear cut a case of "Faulty Service" on the part of Bank and certainly claimant has suffered a loss in the tune of Rs.25,500/- due to late transfer of money in his account, so respondents are directed to do good the loss. They are burdened with Rs.50,000/- as compensation for mental agony which claimant suffered due to "Faulty Service" of the respondents as well as cost of litigation and they are further fined in the tune of Rs.50,000/- which shall be paid in favour of Government in "Government Treasury".
