1. O R D E R M/s. Maqbool Textile Mills Ltd., engaged in the manufacture and sale of yarn, is an undertaking (hereinafter referred to as the 'undertaking') as defined under Section 2(1)(m) of the Monopolies and Restrictive Trade Practices (Control & Prevention) Ordinance 1970 (hereinafter referred to as the 'Ordinance').

2. Mr. Muhammad Ehsanullah Khan, Company Secretary of the undertaking, was directed by Monopoly Control Authority (hereinafter referred to as the "Authority") during hearing on December 4, 2006, in its Camp Office Lahore, to supply the information by December 5, 2006 at its Camp Office but the information could not be supplied at the Authority's Camp Office Lahore on 5-12-2006, whereas, the information was dispatched, through courier service, at its Islamabad office, vide letters No MTM/06/0616/128 and MTM/06/0616/129 dated December 4, 2006, and the same was received in the Authority's office on December 5, 2006.

3. The undertaking, vide its letter No MTM/07/263 dated January 3, 2007 informed that the requisite information was supplied within the given timer frame i.e. 5th December 2006. It also requested for recalling the Order dated December 12, 2006.

4. The Authority, after considering the facts of the case and the fact that the undertaking supplied the requisite information within the given timeframe decided to recall its Order dated December 12, 2006 passed against the undertaking.
