ORDER

' Through this revision petition, the order dated 22.12.2014, passed by the learned Additional Sessions Judge, Khanewal has been called in question, whereby despite remand of the case by this Court, release of the petitioners from jail has been declined.

2. Arguments heard. Record perused.

It has been observed that Criminal Appeals No, 920, 831 & 832 of 2010, and Murder- Reference No, 54 of 2010 were decided by this Court on 26.11.2014, whereby the judgment dated 30.6.2010, passed by the learned Additional Sessions Judge, Khanewal was set-aside and the case was remanded back to the learned trial Court for fresh decision within a span of one month after hearing both the parties. By setting aside of the judgment, the stage prior to pronouncement of the judgment was revived. Meaning thereby that accused, who at that time was/were on bail should enjoy the said facility and who was/were in custody will remain so. The learned trial Court has declined release of the petitioners, on the sole ground that they would create hurdle in conclusion of the matter within the stipulated period. The said contention is not justified. If petitioners/accused make any attempt towards non-cooperation and non conclusion of the proceedings within stipulated period the learned trial Court would be competent to send them behind the bars. behind the bars.
