ORDER

' ABDUL SAMI KHAN, J. --- OBJECTION CASE Learned counsel for the petitioner contends that the petitioners are sons and daughters of Ghulam Abbas deceased and all of them have joint cause of action, therefore, Court-fee is chargeable on their joint petition as one proceeding rather than with reference to the number of petitioners therein. He has relied upon PLD 2013 Lahore 484.

2. I have heard the learned counsel for the petitioners. It has been noticed by this Court that all the petitioners have challenged the order of the learned lower Appellate Court whereby the application filed before the learned Trial Court under Section 12(2), CPC was dismissed. As the petitioners have a joint cause of action, therefore, taking guidance from law laid down supra case, charging of single Court-fee would serve the interest of justice, which has already been affixed with this objection petition by the petitioners.

3. In this view of the matter, the objection raised by the office is overruled. Office is directed to assign a number to this petition. Office objection overruled.
