ORDER

This is an application for bail on behalf of Ata Muhammad petitioner in a case under section 326/34, P. P. C. Registered at police station Karor Pacca vide F. I. R. No. 132 dated 28th July, 1981.

The prosecution case is that the petitioner along with Rab Nawaz co---accused in furtherance of their common intention caused grievous injuries to Muhammad Yasin.

2. Learned counsel for the petitioner submits that the injury on the hand has been declared grievous for the reason that 5th metacarpal bone was found fractured.

3. Learned State counsel opposes this application. He submits that the alleged offence is punishable with imprisonment for life and the peti--tioner is not entitled to the privilege of bail.

4. After hearing the learned counsel for the parties I find that there is a delay of nine days in lodging the F. I. R. The petitioner is in Jail since 13th August, 1981 and there is litigation between the parties. In these circumstances, the petitioner is allowed bail in the sum of Rs. 10,000 (rupees ten thousand) with one surety in the like amount to the satisfaction of A. C., Lodhran.
