' NOOR-UL-HAQ N. QURESHI, J. --- The petitioners have raised three legal issues with regard to issuance of double charge-sheets by two separate authorities, non-providing the requisite documents and non-providing of fair opportunity of hearing.
2. The charge-sheet if issued earlier by Inquiry Committee, later on when the petitioners raised objection by the Authorized Officer. It is yet to be decided by the Departmental Authority if approached by the petitioners. The issuance of charge-sheets by the respective authorities shows providing of opportunity of hearing. The documents so required through application have to be provided in accordance with law, if the petitioners are intended to produce the same in defence.
However, the matter pertains to disciplinary affairs, hence does not fall within the jurisdiction of this Court in view of bar of Article 212 of the Constitution of the Islamic Republic of Pakistan, 1973. At this verge, learned counsel for the petitioners has pointed out that the petitioners are employees of autonomous body, therefore,' they being not civil servants, the petition is maintainable. If this stance is taken into consideration, the proceedings are in accordance with law. Even no adverse order has been passed against the petitioners.
3. In view of above, the instant writ petition is dismissed in lim ine being premature. revisions by the competent authorities. Therefore, it is advisable to consult the official sources or legal professionals for the most up-to-date and accurate information.
